Article 1 – Purpose

These General Terms and Conditions of Sale (“GTC”) govern the contractual relationship between Once Upon Magic (hereinafter referred to as the “Seller”) and any individual or legal entity making a purchase via the website onceuponmagic.com (hereinafter referred to as the “Customer”).

Any order placed on the website implies full and unconditional acceptance of these GTC.

Article 2 – Products

Once Upon Magic offers officially licensed products for sale, including Disney, Loungefly and collectible merchandise.

Products are described and presented with the greatest possible care. However, photographs, visuals and descriptions are provided for informational purposes only and are not contractually binding.

The Seller shall not be held liable for minor errors, omissions or non-substantial differences between the visuals and the delivered product.

Article 3 – Prices

Prices are displayed in euros (€), all taxes included (TTC), excluding shipping costs.

Once Upon Magic reserves the right to modify its prices at any time. However, the applicable price will be the one displayed at the time the order is confirmed by the Customer.

Article 4 – Orders

An order is considered final once payment has been successfully validated.

The Customer will receive an order confirmation email summarizing the purchase.

Once Upon Magic reserves the right to refuse or cancel any order in the event of:

suspected fraud,
payment incidents,
incomplete or incorrect information,
or stock shortages.

If a product becomes unavailable after the order has been placed, the Customer will be refunded the corresponding amount.

Article 5 – Payment

Payment is due immediately upon ordering.

Accepted payment methods are those available on the website at the time of purchase.

Transactions are secured through the payment providers used by Shopify.

Article 6 – Delivery

Orders are shipped to the address provided by the Customer during checkout.

Delivery times are provided for informational purposes only. Once Upon Magic shall not be held liable for delays caused by carriers or exceptional circumstances beyond its control.

The Customer is responsible for ensuring the accuracy of the delivery information provided at checkout.

Article 7 – Disneyland Paris Pickup Service

Once Upon Magic offers a personal shopping service for the purchase and retrieval of exclusive items available at Disneyland Paris.

7.1 – Service Fees

This service is subject to pickup fees corresponding to 5% of the total amount of Disneyland Paris items ordered, in addition to the product price and any applicable shipping fees.

These fees notably cover:

travel expenses,
product sourcing time,
in-store purchases,
order preparation,
and item handling.

7.2 – No Right of Withdrawal or Return

The Customer expressly acknowledges that the pickup service constitutes a personalized personal shopping service involving physical travel and a purchase made specifically at the Customer’s request.

In accordance with Article L.221-28 of the French Consumer Code, the Customer expressly waives their right of withdrawal for products obtained through this service.

No returns, exchanges or refunds will be accepted for orders placed through the Disneyland Paris pickup service, except in the event of a damaged product upon delivery or an error attributable to the Seller.

7.3 – Product Availability

Products available at Disneyland Paris are subject to in-store stock availability. Once Upon Magic does not guarantee the availability of requested items.

In the event of total or partial unavailability, the Customer will be refunded for the unavailable items.

7.4 – Restocking and Exceptional Delays

In the event of temporary stock shortages, Once Upon Magic reserves the right to place an order on hold for up to one month in order to allow for potential restocking of the requested products.

Article 8 – Right of Withdrawal (excluding Pickup Service)

In accordance with Articles L.221-18 and following of the French Consumer Code, the Customer has fourteen (14) days from receipt of the order to exercise their right of withdrawal.

Return shipping costs remain the responsibility of the Customer.

Returned items must be:

new,
unused,
complete,
and in their original packaging.

Any incomplete, used, damaged or unsellable returned product may result in refusal of reimbursement.

Article 9 – Unclaimed Parcels or Returned Shipments

If a parcel is returned to Once Upon Magic due to:

an incorrect address,
failure to collect the parcel within the required timeframe,
or any other reason attributable to the Customer,

Once Upon Magic reserves the right to charge:

personal shopping service fees corresponding to 15% of the order amount,
packaging fees corresponding to 5% of the total order amount,
as well as all original shipping costs and any reshipping costs.

Article 10 – Legal Guarantees

Products sold benefit from the legal guarantee of conformity provided under Articles L.217-3 and following of the French Consumer Code, as well as the hidden defects warranty provided under Articles 1641 and following of the French Civil Code.

Article 11 – Liability

Once Upon Magic shall not be held liable for:

indirect damages,
normal wear and tear of products,
improper use of items,
or damages attributable to the carrier.

In all cases, the Seller’s liability shall be strictly limited to the amount of the order concerned.

Article 12 – Intellectual Property

All content available on onceuponmagic.com, including but not limited to texts, visuals, photographs, logos, product descriptions and graphic elements, is protected by intellectual property laws.

Any unauthorized reproduction, use, distribution or exploitation is strictly prohibited.

Disney, Loungefly and other licensed trademarks, logos and characters remain the exclusive property of their respective owners, including The Walt Disney Company and its subsidiaries.

Once Upon Magic reserves the right to initiate legal proceedings against any individual or legal entity infringing its intellectual property rights, including unauthorized reproduction, use, distribution or exploitation of visuals, photographs, texts, product descriptions, graphic elements or any content displayed on the website.
